The rescheduling hearings are over. What’s next?

After 11 days, the hearings that determine whether or not some marijuana will be rescheduled to Schedule III came to an end in the middle of last month. Now, the transcripts are still being reviewed and the judge has yet to give an opinion. Each side of the case has until August 17th to make any corrections to the transcript, and then after that these transcripts will become public.

Releasing the transcripts will be a big deal considering how closed doors the entire process has been. Only a select few media voices were allowed in the room, and none of it was televised or livestreamed in any way. The media allowed inside was not allowed to use recording devices.

The judge in the case will then make his decision, which will go to the DEA Administrator Terry Cole for his final decision. Then, THIS decision will most likely go back for judicial review. It’s a long windy road.

Depending on this final decision, these public transcripts can be used for any appeals later on.

The essential question is whether or not the government was able to prove that marijuana has any medical use. If they were able to do so, the Judge in the case will most likely decide in favor of rescheduling.

But for now, we wait until the transcripts are released on August 17th, and a decision will come after that.
